Technology market:  

The development of technology market in Shanghai can be divided into three phases:

Start-up period (70s to mid-80s)
The initiation of paid S&T achievement transfer and the establishment of technology-market-related organizations

Formation period (mid-80s to mid-90s)
The formation of multi-channel/layered technology market networking and Shanghai Technology Transfer and Exchange (STTE)

Maturation period (mid-90s to now )
The establishment of Shanghai Technology Property Exchange

From January to July 2009, the number of accredited-and-registered technology contract was 14690, with a year-on-year growth rate of 9.0%. Total transaction value reached 27.29 billion RMB, with a year-on-year growth rate of 19.5%. Average transaction value per contract reached 1.85 million RMB, which is 9.8% higher than average transaction value per contract of 2008. Total transaction value of technology development contracts was 14.6 billion RMB (year-on-year growth rate 62.8%); total transaction value of technology service contracts was 2.67 billion RMB (year-on-year growth rate 80.7%); total transaction value of technology assignment contracts was 9.6 billion RMB (year-on-year decrease rate 19.5%); total transaction value of technology consulting contracts was 0.36 billion RMB (year-on-year decrease rate 10.4%)

From January to October this year, the turnover of technology contract has reached 40 billion RMB. 21064 technology transactions have been completed, with a growth rate of 30% year-on-year.

Policies and measures
  

According to the arrangement of central government, Ministry of Science and Technology and Shanghai Municipality implemented series of policies and measures to promote the development of technology market system.

Patent law (third amendment)
On March 12, 1984 the fourth meeting of the Standing Committee of the Sixth National People's Congress adopted the Patent Law of the People's Republic of China, effective April 1, 1985.

The patent law:

  1. Encouraged and motivated the innovation;
  2. Rationally adjusted the economic relationship in innovation;
  3. Protected and respected the knowledge, achievements and fair play;
  4. Stimulate the spread of S&T information, import of advanced technologies;
  5. Promote the application and industrialization of innovative achievements

The third amendment was adopted on December 27, 2008.

 

Law of People’s Republic of China on Science and Technology Progress

On July 2, 1993, the second meeting of the Standing Committee of the Eighth National People's Congress adopted <Law of People’s Republic of China on Science and Technology Progress>, effective October 1, 1993. The law is aimed to instruct and promote S&T development of China. It is the fundamental legal ground of S&T principles, policies and law making. The law consists of 10 chapters and 62 clauses.

Several supporting policies on implementing <National medium-to-long-term S&T development planning outline>

The Outline is published in February, 2006. The Outline is divided into 10 parts, which are: preface, guiding principle, target and general arrangement, key domains and themes with priority, major projects, frontier technology, basic research, S&T system reform and national innovation system construction, several important policies and measures, S&T input and construction of S&T fundamental environment platform, talent team building. The Outline indicates the guideline of S&T work in next 15 years

Measures for administration of the recognition of new high-tech enterprises

<Measures for administration of the recognition of new high-tech enterprises> was issued by the Ministry of Science and Technology, Ministry of Finance and State Administration of Taxation on April 14 2008 and effective as of January 1 2008.

Article 4 of the circular states that recognized high-tech companies under this circular is qualified to enjoy the preferential 15 percent corporate income tax rate. The restrictions have been set with limited scope that few enterprises, whether domestic or foreign company, have any hope of qualifying for. The door for any enterprise wanting to get corporate income tax incentives though purchasing technique for third parties or bringing in outdated technologies has been closed.

The circular defines high-tech companies as resident enterprises registered in mainland China for more than one year and that continually concentrate on researching and developing their own core intellectual property rights in order to carry out business within the scope of “State-encouraged New Hi-Technology Areas.”

Main stakeholders

Science and Technology Commission of Shanghai Municipality

Science and Technology Commission of Shanghai Municipality (STCSM) is one of the component departments of the Municipal Government in charge of the whole Municipality’s work of science and technology. The major duties of STCSM include: implementing the strategies, guidelines, policies and laws, rules and regulations of the State related to the work of science and technology; studying and drawing up the drafts of rules, regulations and policies concerning this Municipality’s science and technology development; studying and determine the layout of this Municipality’s science and technology development and the fields of science and technology that enjoy priority of development; and undertaking other tasks assigned by the Municipal Government, etc.

 

Incubators in Shanghai
First Shanghai based S&T incubator, STIC was built in 1988. Till now, there are 35 incubator scattered throughout Shanghai. Among the 35 incubators, 15 are state-level Hi-tech innovation centers, the gross area of which is around 590,000 square meters. Total number of incubatee exceeds 2000.
